What is the ruling on a person urinating while standing, is it forbidden or permissible?

Answer :

It is not forbidden for a person to urinate while standing, because it has been authentically reported by al Bukhari and Muslim, on the authority of Huthaifah, may Allah be please with him, that the Prophet (Sallallaahu alayhi wasallam) came to the rubbish pit of a people and urinated while standing (al-Bukhari no.226).

Permission to urinate standing has also been narrated from Umar, Ali, ibn Umar and Zaid bin Thaabit, may Allah be pleased with them, due to the above mentioned Hadith.

But it is prescribed by the Sunnah for a person to urinate sitting, according to the words of A’ishah, may Allah be pleased with her, who said: ‘Whoever told you that the Prophet (Sallallaahu alayhi wasallam) urinated standing, do not believe him. He did not urinated except sitting.’ (At-Tirmithi no.12 and an-Nisaa’i no. 29) at-Tirmithi said: ‘This is the best and most correct saying in this matter – also because it is better to guard and protect him from being splashed with his own urine.’

From the evil and reprehensible matters is that some who claim to be from Banu Haashim (i.e. claim to be a Sayyid; someone related to the Prophet sallallaahu ‘alayhi wa sallam’s family) say that there is no kafaa’ah (marriage compatibility) between them and someone from outside of their own clan. So they do not get married outside of their clan, nor allow anyone from outside of their clan to marry them. This is a great error, a monstrous ignorance, oppression against the woman, and it is a legislation which neither Allaah nor His Messenger sallallaahu ‘alayhi wa sallam legislated or prescribed. Rather, Allaah – the Most High – said:

“O mankind! We have created you from a male and female, and have made you into nations and tribes; that you may know one another, Indeed the most noblest of you with Allaah is the one who has the most taqwaa (piety, fear, and obedience of Allaah).” [Soorah al-Hujuraat 49:13].

“Indeed the Believers are but brothers.”

[Soorah al-Hujuraat 49: 10].

“The Believers – men and women – are allies and protectors, one to another.” [Soorah at-Tawbah 9:71].

“So their Lord accepted from them their supplication, and responded: Never will I allow to be lost the actions of any of you, be they male or female. You are one to another.”

[Soorah Aal-'lmraan 3:195].

Allaah’s Messenger sallallaahu ‘alayhi wa sallam said: “Indeed there is no excellence for an arab over a non-arab, nor for a non-arab over on arab, nor for a white person over a black one, nor for a black person over a white one, except through taqwaa (piety and obedience to Allaah). The people are from Aadam, and Aadam was from earth.”[1]

The Prophet sallallaahu ‘alayhi wa sallam also said: “Indeed my awliyaa (friends and allies) are not the tribe of so and so. Rather my friends and allies are the muttaqoon (those who possess taqwaa) – wherever they may be.”[2]

The Prophet sallallaahu ‘alayhi wa sallam said: “If there comes to you a person whose Religion and character are pleasing to you, then marry him (i.e. give the girl in marriage to him). If you do not do this, there will be Fitnah (trial and discord) and greet fasad (corruption) upon the earth.” This was related by at-Tirmidhee and others, with a hasan isnaad (good chain of narration).[3]

The Prophet sallallaahu ‘alayhi wa sallam married Zaynab bint Jahsh of the Quraysh (i.e. the Prophet’s clan) to Zayd ibn Haarithah, his freed slave. He married Faatimah bint Qays from the Quraysh clan, to Usaamah, the son of Zayd. Bilaal ibn Rabaah, the Ethiopian married the sister of ‘Abdur-Rahmaan ibn ‘Awf of the Quraysh. So the purpose here is to explain the falsehood of those who claim that it is forbidden, or detested, for someone from the Prophet’s sallallaahu ‘alayhi wa sallam’s clan to marry outside of that clan or tribe. Rather, what it is obligatory in this matter is to consider only Religion as the compatibility factor. So the Prophet sallallaahu ‘alayhi wa sallamdistanced Abu Taalib and Abu Lahab (his uncles) – because they were not Muslims and drew near Salmaan the Persian, Suhayb the Roman, and Bilaal the Ethiopian. This is because they possessed eemaan (faith) and piety, and they followed the Prescribed Laws and traversed the Straight Path. Thus, whosoever adopts this false and ignorant practice of barring Haashmee women from marrying from outside of their clan or tribe, will only achieve blameworthy results; such as corruption of the people, or adversely affecting the birth-rates, even though Allaah – the Most High – said:

“And marry those amongst you who are single, and the righteous from your slaves. If they be poor, Allaah will enrich them out of His Bounty, And Allaah is all-Sufficient for His creation, the all-Knowing about their state.” [Soorah an-Noor 24:32].

So He commanded to marry those that are single, and to marry all other categories of Muslims – irrespective of whether they be rich or poor. Thus, since the Islaamic Sharee’ah urges and encourages the institution of marriage. So the Muslims should hasten to fulfill this command of Allaah and of His Messenger sallallaahu ‘alayhi wa sallam when he said:

“O youths! Whosoever amongst you has the ability to marry, then let him do so; for it lowers the gaze and restrains the private parts. But whosoever does not have the ability then let him take to fasting; for indeed it is a shield for him.”[4]
Its authenticity has been agreed upon.

Thus, it is incumbent upon the guardians to fear Allaah concerning their guardianship, since it is an amaanah (trust and responsibility) around their necks, and Allaah will question them concerning this trust. So it is upon them to hasten in getting their daughters, sons, and sisters married, to the extent that this task has taken full effect in life, and the corruption and harms of not doing so have been minimised. And it is known that when women are prevented from getting married, or if their marriage is delayed and deferred, then this is a cause for calamities to occur, a cause for shameful moral crimes to take place, and a cause for a decline in standards of behaviour. So – O worshippers of Allaah – it is upon you to fear Allaah regarding your own selves, and with regards to the daughters, sisters, and other women whom Allaah has been placed under your charge and authority, and that the Muslims should come in order to realise the good and the happiness for the society, and to follow the path that will increase the good and lessen the crimes. And you should know that you will all be questioned and held to account about your actions, as Allaah – the Most High – said:

“By your Lord! We shall call them all to account for all that they used to do.” [Soorah al-Hijr 15:92].

And Allaah – the Mighty and Majestic – said:

“And to Allaah belongs all that is in the heavens and the earth, that He may punish those who do evil with that which they have done; and reward those who do good with Paradise which is best.” [Soorah an-Najm 53:31].

So hasten in getting your sons and daughters married, following in the footsteps of your Prophet sallallaahu ‘alayhi wa sallam, and the footsteps of the noble Sahaabah (Companions) radiallaahu ‘anhum, and all those who follow their path and guidance. I also advise you all not to seek excessive sums for the mahr (dowry), but rather be moderate in this, and that you strive to select pious and righteous people for marriage.

We ask Allaah to grant us the understanding of the Religion; grant us firmness upon it; and that He protects us and all the Muslims from the evil promptings of our own souls, and our evil resultant actions; and that He keeps away from us the deviating trials and discords, whether open or hidden. And We ask Allaah also to correct all those who have a position of authority over the affairs of the Muslims, and that He rectifies them. Indeed he is the One having the power to do so. And may Allaah extol and send blessings of peace upon Muhammad, and upon his Family, Companions and all those who follow them.

Laylat al-Qadr has a great virtue, because it was witness of the revealed of Al-Qur’an Al-Karim, which guided the people who hold it to the path of glory and lifted them into degrees of noble and eternal. Muslims who follow the sunnah’s Apostle set no specific signs nor the arrows stuck to commemorate this night, but they compete to wake up at night with the full faith and expecting reward from Allah. Here, O my brothers and sisters -Muslims, Qur’aniya’s verses and hadiths Nabawiyah that are saheeh describes these nights.

<1>. The virtue of Laylat al-Qadr

Suffice the high position of Laylat al-Qadr to know that night is better than a thousand months, Allah has said. Which means :

“Verily We have sent it down on the Night of Power, And what will make thee know what the Night of Power is? The Night of Power is better than a thousand months, The angels and the sprit descend therein by the command of their Lord with His decrees for every affair, It is all peace till the rising of the dawn,”

[QS al-Qadr: 1-5]

And on that night described all affairs, full of Wisdom.

“Verily We have sent it down on a blessed night, verily We were to become warners, Therein is decreed every affair of wisdom, As a command from before Us. Verily We were to become senders, A mercy from thy Lord. Verily He! He is the Hearer, the Knower.”

[QS Ad-Dukhan: 3-6]

<2>. The time

It was narrated from the Prophet sallallaahu ‘alayhi wa sallam that night is occurred on the date of 21,23,25,27,29 and final night of Ramadan. [1]

Imam as-Shafi’i said: “According to my understanding, Allah knows best the truth, the Prophet sallallaahu’ alaihi wa sallam answer according to a question which asked to him: “Are we looking at tonight?”, He replied: “Look at those nights” [As taken by al-Baghawi in As-Syarhus-Sunnah 6/386]

The most powerful opinions, the night of Laylat al-Qadr happen on the last nights of Ramadan based on the hadith from ‘Aisha radiyallahu ‘anha, she said that the Prophet sallallaahu ‘alaihi wa sallam i’tikaf in the last ten days of Ramadan, and He said: “Look for night of Laylat al-Qadr in the (odd nights) on the last 10 days of Ramadhan” [Narrated by Bukhari 4/225, Muslim 1169]

If a person feels weak or incapable, don’t lose of the last seven days, because the history of Ibn Umar, (he said): Messenger of Allah sallallaahu ‘alaihi wa sallam said: “Look at the last ten days, if not capable then don’t let escapes the seven days rest” [Bukhari 4/221, Muslim 1165]

It interprets his saying “I saw your dreams have happened, look at whoever is looking for the last seven days.” [See the Reference earlier]

It has been found in the Sunna, the notification exists because the debate of the prophet’s companions. From Ubadah ibn Saamit radiyallahu ‘anhu, who said: Messenger of Allah sallallaahu ‘alaihi wa sallam out on the night of Laylat al-Qadr, there are two of prophet’s companions arguing, He said. “I came out to tell you about the nights of Laylat al-Qadr, but there are two people argue until can no longer known when (forgot of the time); maybe this is better for you, look at the night of 29, 27, 25 (and in another narration: seven, nine and five)”

[Bukhari Hadith 4/232]

There have been many hadith which suggests the night of Laylat al-Qadr, in the last ten days, others asserted, on the odd night of last ten days. The first hadith is a general explanation and the second hadith is special, so the special history take precedence over the general, and have many more hadith explains that the night of Laylat al-Qadr is in the last seven days of Ramadan, but it is limited if unable and weak, no problem, with all of this hadiths, they are match, mutually strengthen and uncontradictory, even unite and unseparate.

Conclusion : If a Muslim seeking the night of Laylat al-Qadr, look at the odd night last ten days: 21, 23, 25, 27 and 29. If they are weak and unable to find the last ten days, then look at the odd night last seven days ie 25, 27 and 29.

And Allaah knows best the truth.

<3>. How to Find Night Laylat al-Qadr?

Truly in this blessed night, whoever is forbidden to get it, it really has forbidden all the good (for him). And it is unlawful the good for someone, but (for) those who are forbidden (to get). Therefore advisable for Muslims (so) excited in the act of obedience to God to turn the night Laylat al-Qadr with faith and hope for His great reward, if you (have) to do so (then) Allah will forgive all of your sins in the past. Prophet sallallaahu ‘alaihi wa sallam has said :

“Whoever stands (prayer) on the night of Laylat al-Qadr with faith and hope for reward from Allah, then his sins are forgiven past”

[Hadith Bukhari 4/217, Muslim 759]

It is sunna to multiply prayer at this night. It has been narrated from Aisha Radiyallahu ‘anha, (she) said: “I asked, ‘O Messenger of Allah! What do you think if I know when the Laylat al-Qadr night (occur), what should I say?’ He replied, ‘Say: “Allahumma innaka ‘afuwwun tuhibbul afwa fa’fu’annii”, “O Allah, You are Forgiving and love people who ask for forgiveness, then forgive me!” [2]

O’ My brother -may Allah blessing you, give thee Taufiq to obey Him-you already know how the state of nights Laylat al-Qadr (and virtues) then got up (to uphold the prayer) at ten last night, switched it with the worship and stay away from women, commanded to your wife and your family for that, multiply your act of obedience.

From Aisha Radiyallahu ‘anha “It is the Messenger of Allah sallallaahu’ alaihi wa sallam, when entered at ten days (last month of Ramadhan), he tighten his clothes [3] turn the night and wake his family”

[Hadith Bukhari 4/233 and Muslim 1174]

Also from Aisha, (she said): “It is the Messenger of Allah sallallaahu ‘alaihi wa sallam earnest (worship if already entered) the night the tenth (last) that he never did on other nights.”

[Narrated by Muslim 1174]

<4>. The Signs

Know O the obedient devotee of Allah, may Allah toughen you with the spirit from Him and help with His assist –Indeed the Prophet sallallaahu ‘alaihi wa sallam described the morning of the Laylat al-Qadr night to know a Muslims, From ‘Ubay ibn Kaab Radiyallahu ‘anhu, he said: Messenger of Allah sallallaahu ‘alaihi wa sallam said, “In the morning of the Laylat al-Qadr night, the sun was shine unblinding, like a tray to rise” [Hadith Muslim 762]

From Abu Hurairah, he said: We mention the nights Laylat al-Qadr in the Prophet sallallaahu ‘alaihi wa sallam, he said.

“Who among you who remember when the rising moon as syiqi jafnah” [4] And from Ibn Abbas Radiyallahu ‘anhuma, he said: Messenger of Allah sallallaahu ‘alaihi wa sallam said. “(Evening) Laylat al-Qadr is a beautiful night , glorious weather, not hot nor cold, (and) the next day, the sunlight shine weakens reddish light.” [Tahayalisi 349, Ibn Khuzaimah 3/231, Bazzar 1/486, hadith Hasan]

One day, Abu Abdillah al-Qalanisi on his journey by boat. Suddenly, a high wind shaking the boat. All of the passengers said a prayer with Husu’ (in all seriousness) for the sake of their safety and said a nazar (a promise). The passengers said to Abu Abdillah, “Each of us have pledged to Allah and said a nazar for our safety. Then you should also said a nazar and swear to Allah.” He replied, “I’m the one who doesn’t care about the world, so I don’t need a nazar.”

But they forced me. Then I swore, “By Allah, if Allah the Almighty saves me from the disaster that happen to me, I won’t eat an elephant’s meat.” They asked, “Is it a permissible nazar? is there anyone who wanna eat an elephant’s meat.?” I replied, “That’s my choice, may Allah give a reward to my tongue which had spoken those words.” Indeed, not long after that the ship was broken. All of The passengers were stranded on a beach. For days we were on the beach without eat any food.

When we were sitting to took a rest, there was a young elephant passed in front of us. They captured the young elephant, slaughtered and ate it. They offered me to ate like them. I replied, “I’ve said a nazar and vowed to Allah wouldn’t eat an elephant’s meat.” They made excuses, that I was in a state of forced, therefore allowed to cancel it. I rejected those reasons, I still met my oath. After eating, they were full and fell asleep. While they were sleeping, the mother elephant came and looked for her baby, she followed a trail of her baby’s footprint and sniffed. finally she found her baby’s bone.

The mother elephant had arrived at our resting place, I noticed her. She sniffed us one by one, every time she smelled her baby’s flesh on the man, she trampled the man by her feet or hands till death. Now they all have died. It is time for the mother elephant approached me, she sniffed on me but didn’t get the smell of her baby’s meat on me. Then she moved his back body and gestured, then lift the tail and legs.

From her gestures I understood that she wants me to rode on her back. Then I rode and sat. She motioned me to sat quietly on her back. She took me run fast that night till a farm which a lot of trees. She motioned me to get down by stepping on her leg. Then she ran faster than before. In the morning, I observed arround, there was farm fields and a group of people. They took me to the headman’s house. A spokesman for the tribe asked me to speak. Then I introduced myself and told them about my experience with the boat and several people in there

The spokesman said to me, “Do you know how far your journey with the elephant is.?” I replied, “I Don’t know!” He said, “As far as an eight-day journey! Whereas the Elephant brought you in one night only.” Then I was allowed to stay with them in the village so I got a job. After that, I returned to my village.

Fasting has a very close relations with the jihaad. Fasting provides a solid preparation for it. Fasting is always accompanied Jihaad on its way of life continually until Allah bequeath the earth and all of its content. Thus, fasting will always remain there until the day of Judgement as a phase of preparation for jihaad. Jihaad itself will always remain there until the day of Judgement as an ‘Amaliah (application) phase for fasting.

Muslims are the people who like fasting and also a mujahid (warrior) who is able to benefit from the fasting educational institution as a means education for jihaad. As long as Muslims continue to fast truthfully, then it keeps him as a mujahid. Therefore, many victories obtained by the Muslims during Ramadan.

In year 2 Hijri, occurred the battle of Badr al-Kubra in Ramadan. This war ended with the victory of Islam over the paganist at the initial resistance of physical war. This victory is very closely related to the course of history, where group of believers (mu’min) who are few defeated the paganist which are in a greater number and a much stronger group.

In the month of Ramadan in the year 5 Hijri, the Muslims make preparations for the Khandaq war, where the war This took place in Shawwāl in the same year. In the month of Ramadan in the same year, the Prophet sallallaahu ‘alaihi wa sallam sent troops to crush the idols. This is a very important military task, because of there is possibility of war crash.

In 21st Ramadan of 8 Hijri, it is the greatest liberation, the liberation of the Mecca city (Fat-hu Mecca), until the leaders surrendered after a long time of hostility. Finally they convert to the religion of Allaah, Islaam. The statues are also falling by the “hit” of the Prophet sallallaahu ‘alaihi wa sallam. Allah the Almighty has said:

(1)إِذَا جَاء نَصْرُ اللَّهِ وَالْفَتْحُ

(2)وَرَأَيْتَ النَّاسَ يَدْخُلُونَ فِي دِينِ اللَّهِ أَفْوَاجاً

(3)فَسَبِّحْ بِحَمْدِ رَبِّكَ وَاسْتَغْفِرْهُ إِنَّهُ كَانَ تَوَّاباً

“When there come the succour of Allah and victory, and thou finds the mankind entering the religion of Allah in crowds. So glorify the Praises of your Lord, and ask His Forgiveness. Verily, He is the One Who accepts the repentance and Who forgives.” (QS An-Nasr: 1-3)

In the month of Ramadan in 9 Hijri, there is a war of Tabuk.

Also In the month of Ramadan in 10 Hijri, the Prophet sallallaahu ‘alaihi wa sallam sent Ali ibn Abi Talib radiyallahu ‘anhu to lead the troops to Yemen, to send with him a letter addressed to them.

There are still many other devastating wars conducted by the Muslims in the month of Ramadan in the fight against the enemies. One of the Important battle for them is the battle that was led by a Muslim hero, Saladin al-Ayyubi against the Crusaders and the ‘Ain Jalut battle or “Spring of Goliath”, in which the Muslims managed to drive out troops from the Tartars. All this happened during Ramadan, which is a month of worship and victory. Will the Muslims repeated those victories, and restore historical Salafush-Salih? [1]
